A look at our legal work

A marketing business client lost a key employee whom they suspected was planning to start a competing business in another state. Using a forensic computer expert, Attorney Mizner was able to pinpoint when the employee first started making plans to leave as well as prove that the employee had misappropriated contact and pricing information. Through aggressive discovery and sheer tenacity, Attorney Mizner demonstrated that the former employee had breached his contract with the business, engaged in unprofessional personal conduct, and had received ill-gotten gains by stealing the business's trade secrets and valuable customers. The employee agreed to a significant settlement and fair limits on pursuing his client's customers to avoid the exposure of a jury trial.

Another business client learned that a professional employee was planning to leave to start a competing business. Knowing that the employee held valuable information about our client's company, Attorney Mizner arranged for a court order, seizing the employee's home computer. Using a computer forensics expert, we analyzed both the employee's work and home computers to determine whether proprietary information had been compromised. Swift and aggressive action ultimately protected the client's confidential information, business integrity and peace of mind, while causing the former employee to rethink his new business plan.

 

Real Experience

In 2023, the Mizner Law Firm represented a manufacturer whose long-time employee moved to a competitor, and promptly began soliciting the former employer’s customers. The Mizner Law Firm quickly investigated and filed a lawsuit, seeking a preliminary injunction against the former employee and the competitor. The case quickly resolved via an agreement to repay lost profits, and an agreement that the former employee would not solicit the customers
